Terms & Conditions

These Terms and Conditions (“Terms”) govern the access to and use of the Dibbzy website, QR-based smart tags, software, and related services (collectively, the “Services”).

The Services are operated by Dibbzy, a brand of QuicHub (“Company”, “we”, “us”, “our”).

By purchasing, activating, scanning, registering, or using a Dibbzy QR tag or website, you agree to be legally bound by these Terms.

If you do not agree, do not use the Services.


1. NATURE OF SERVICE

Dibbzy provides QR-based identification tags that allow users to link contact information to physical items (including pets, vehicles, keychains, bottles, bags, and other objects).

Dibbzy is a technology facilitation platform

  • Does not physically track items
  • Does not provide GPS tracking
  • Does not guarantee recovery of lost items
  • Does not verify ownership claims unless legally required
  • Dibbzy is not a recovery agency, insurance provider, or law enforcement entity.

2. ELIGIBILITY & LEGAL CAPACITY

You represent and warrant that:

  • You are at least 18 years old
  • You have legal capacity to enter into binding contracts
  • All information provided is accurate and lawful
  • You have lawful ownership or authority over the item registered
  • Providing false ownership information may result in account termination and legal action.

3. USER RESPONSIBILITIES & STRICT MISUSE PROHIBITION

You agree NOT to:

  • Register items you do not own
  • Use the QR tag for fraud, impersonation, or illegal activity
  • Upload misleading emergency or contact information
  • Use the platform to stalk, harass, threaten, or extort
  • Collect scanner data for unlawful marketing
  • Attempt to reverse engineer or hack the system
  • Interfere with platform security
  • Use automated bots to scrape scan data
  • Any misuse may result in:
  • Immediate suspension without notice
  • Permanent account termination
  • Reporting to law enforcement

Civil or criminal legal proceedings


4. PUBLIC VISIBILITY DISCLAIMER

By activating a Dibbzy tag, you understand and agree:

  • Information you choose to display may become accessible to anyone who scans the QR code
  • You control what information is made visible
  • Dibbzy is not responsible for misuse of publicly displayed information
  • You assume full responsibility for the information you choose to link to your tag.

5. NO WARRANTY & “AS IS” BASIS

The Services and QR tags are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by Indian law, Dibbzy disclaims:

  • All express or implied warranties
  • Merchantability
  • Fitness for a particular purpose
  • Continuous uptime guarantees
  • Error-free operation
  • Data accuracy guarantees
  • Recovery success guarantees
  • We do not warrant that:
  • The QR code will always be scannable
  • Internet services will always function
  • Third parties will contact you upon scanning
  • Data will never be subject to cyber threats

6. LIMITATION OF LIABILITY (STRICT CAP)

To the maximum extent permitted under applicable law:

  • Dibbzy shall NOT be liable for:
  • Loss of pets
  • Loss of vehicles
  • Theft of property
  • Emotional distress
  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Loss of profits
  • Loss of reputation
  • Data loss
  • Third-party misconduct

Total aggregate liability shall not exceed:

👉 The amount paid by you for the specific product purchased OR INR 1,000 — whichever is lower.

This limitation applies even if we were advised of possible damages.


7. NO GUARANTEE OF RECOVERY

Dibbzy does not guarantee that:

  • A lost pet will be found
  • A stolen vehicle will be returned
  • A misplaced item will be recovered
  • Recovery depends entirely on third-party human action beyond our control.
  • You acknowledge this risk at the time of purchase and activation.


8. INDEMNIFICATION (EXPANDED)

You agree to fully indemnify, defend, and hold harmless Dibbzy, its founders, directors, employees, affiliates, and partners from:

  • Any claims arising from misuse of the tag
  • Ownership disputes
  • False registration
  • Data disputes
  • Legal claims by third parties
  • Scanner complaints
  • Regulatory penalties caused by your actions
  • Including reasonable legal costs and attorney fees.


9. FRAUD, IMPERSONATION & CRIMINAL USE

If we suspect fraud, impersonation, identity misuse, or criminal activity:

  • We may freeze access immediately
  • We may preserve digital logs
  • We may cooperate with law enforcement
  • We may disclose relevant records as required by law
  • We reserve the right to investigate any suspicious activity without prior notice.


10. DATA & PRIVACY

All personal data processing is governed by our Privacy Policy and handled in compliance with:

Digital Personal Data Protection Act, 2023

Applicable Indian laws

You remain responsible for the data you choose to display via your QR tag.


11. TECHNICAL INTERRUPTIONS

We are not liable for service disruption due to:

  • Internet outages
  • Hosting failures
  • Cyber attacks
  • Government restrictions
  • Force majeure events
  • Software updates
  • Maintenance downtime


12. PRODUCT DISCLAIMER

Physical QR tags:

  • May experience wear and tear
  • May be damaged by environmental exposure
  • May degrade if scratched or altered
  • We are not liable for damage due to misuse, improper attachment, or environmental exposure.


13. ACCOUNT TERMINATION RIGHTS

We may suspend or permanently terminate your account without prior notice if:

  • You violate these Terms
  • We receive legal complaints
  • We detect suspicious activity
  • Required by regulatory authorities
  • Termination does not eliminate your liability for prior actions.


14. GOVERNING LAW

These Terms shall be governed by and construed under the laws of India.

Courts located in [Bangalore, Karnataka] shall have exclusive jurisdiction.


15. ARBITRATION (STRONG FORM)

Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved by:

Conducted under the Arbitration and Conciliation Act, 1996

Language: English

Single arbitrator appointed by Dibbzy

The arbitration award shall be final and binding.

You waive the right to participate in class actions or collective proceedings.


16. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, remaining provisions shall continue in full force.


17. MODIFICATIONS

We reserve the right to modify these Terms at any time.

Continued use of the Services constitutes acceptance of updated Terms.
